Legal framework and legal sources for the prohibition of discrimination in private legal relations, analysis of defining the concept of various forms of discrimination in employment relations, family and inheritance relations, access to goods and services, the most frequent prohibited basis of discrimination in judicial practice, analysis of existing procedural mechanisms of protection against discrimination, the stages of anti-discrimination litigation procedure, the special features of the burden of proof in anti-discrimination law, the role of the Ombudsperson in protection against discrimination, the legal framework and protection mechanisms in European anti-discrimination law.
Goal
The aim of the course is to introduce students to the private aspect of anti-discrimination protection. The prohibition of discrimination traditionally relates to public law, but the purpose of this course is to indicate in what way and through which mechanisms the prohibition of discrimination operates in private law, in what relations, in relation to which subjects and in what way discrimination can be done, and how effective the protection mechanisms are. Special attention will be paid to the specifics of the anti-discrimination litigation procedure, the specifics of shifting the burden of proof, both in relation to discriminatory phenomena in general, and in relation to specific forms of discrimination, such as mobbing.
Teaching methods
Teaching is carried out through lectures, as well as through monitoring the cases at hearings.
Knowledge testing methods
Knowledge assessment is carried out through evaluation of student activities during teaching, presentation of analyses of cases monitored at hearings, and a written test with a practical problem (case) and an oral exam. A written test is eliminatory and a prerequisite for the oral part of the exam.
Competences
Students will be able to: - recognize the occurrence of discrimination and recognize the manifestation of discrimination - successfully conduct the discrimination test in relation to the particular situation - assess which protection mechanism is the most appropriate in a particular case of discriminatory behavior - point out the particularities of the anti-discrimination litigation procedure - understand and distinguish specific evidence to prove discrimination - apply the relevant European and international legal framework and jurisprudence.
